Terms & Conditions

These terms explain the basis on which you may access and use Plan2Price.

1. About these terms

These Terms & Conditions govern access to and use of Plan2Price (the Service). By creating an account, starting a trial, purchasing a subscription or otherwise using the Service, you agree to these terms.

Plan2Price is intended for use by businesses, contractors, tradespeople and other professional users. It is not intended as a consumer service.

2. What Plan2Price does

Plan2Price provides digital tools that can help with planning work, creating or marking up drawings, calculating quantities, preparing estimates and prices, recording project information and tracking progress. Features may be added, changed or removed as the Service develops.

The Service is a productivity and estimating tool. It does not provide architectural, engineering, fire-safety, building-control, legal, tax or other professional advice.

3. Your responsibility for checks

You remain responsible for all decisions made using information produced by Plan2Price. Before relying on an output, placing an order, submitting a quotation, carrying out works or issuing information to a client or third party, you must check it for your particular project.

This includes checking, where relevant:

  • site dimensions, measurements and drawing scales;
  • drawings, layouts, specifications and design requirements;
  • material quantities, waste allowances, pack sizes and product availability;
  • labour rates, material prices, margins, tax and other commercial assumptions;
  • manufacturer instructions, technical data and system compatibility; and
  • applicable contracts, regulations, approvals and site conditions.

Plan2Price calculations and outputs depend on the information, settings and assumptions supplied by you. An output may be inaccurate where information is incomplete, incorrect, outdated or unsuitable for the job.

4. Accounts and security

You must provide accurate account information and keep it reasonably up to date. You are responsible for keeping login details confidential and for activity carried out through your account, except to the extent caused by a failure on our part.

You must tell us promptly if you believe your account has been accessed without permission. We may suspend access where reasonably necessary to protect the Service, your account or other users.

5. Trials, subscriptions and payment

We may offer a free trial. The trial length and any restrictions will be shown when you sign up. Unless we clearly tell you otherwise, no payment is taken merely for starting a free trial.

If you choose a paid plan, the price, billing period and features will be shown before you purchase. Subscription fees are payable in advance and may renew automatically for successive billing periods unless cancelled before the next renewal date.

You may cancel a paid subscription using the cancellation method made available by Plan2Price. Unless otherwise stated at purchase, cancellation stops future renewal and access continues until the end of the period already paid for. Fees already paid are non-refundable except where required by law or where we expressly agree otherwise.

We may change subscription prices for future billing periods by giving reasonable notice. A price change will not retrospectively alter a period already paid for.

6. Acceptable use

You must use the Service lawfully and for legitimate business purposes. You must not:

  • attempt to gain unauthorised access to the Service, another user's account or connected systems;
  • introduce malicious code, deliberately overload the Service or interfere with its operation;
  • use the Service to store or share unlawful, infringing or harmful material;
  • copy, resell, sublicense or commercially exploit the Service except as expressly permitted;
  • reverse engineer or attempt to extract source code except where such restriction is prohibited by law; or
  • use automated means to scrape or extract substantial parts of the Service without permission.

7. Your project data and content

You retain ownership of drawings, project information, prices, room data and other content that you upload or create using the Service (Your Content).

You give us a limited right to host, copy, process and transmit Your Content only as reasonably necessary to operate, secure, maintain and improve the Service and provide it to you.

You must have the necessary rights and permissions to upload and use Your Content. You should avoid uploading information that you are not authorised to disclose.

8. Intellectual property

All intellectual property rights in Plan2Price itself, including its software, code, interface, branding, designs, documentation and original content, belong to Plan2Price or its licensors. Except for the limited right to use the Service under these terms, no intellectual property rights are transferred to you.

9. Availability, maintenance and changes

We aim to provide a reliable Service, but we do not guarantee that it will always be available, uninterrupted or error-free. Maintenance, updates, internet issues, third-party services and events outside our reasonable control may affect availability.

We may update or change the Service to improve functionality, security or performance, comply with law, or reflect changes in our products. We will try to avoid materially reducing paid functionality without reasonable notice where practicable.

10. Third-party services

Plan2Price may rely on or integrate with third-party services such as hosting, authentication, storage, payment processing or other software. Those services may be subject to their own terms and availability. We are not responsible for a third-party service to the extent a problem is outside our reasonable control.

11. Data protection and privacy

We process personal data in accordance with the Plan2Price Privacy Policy. You are responsible for ensuring that any personal data you add to a project or upload to the Service is used lawfully and that you have an appropriate basis for doing so.

12. Suspension and termination

You may stop using the Service at any time and may cancel a paid subscription in accordance with section 5.

We may suspend or terminate access where you materially breach these terms, fail to pay amounts due, create a security risk, misuse the Service, or where we are required to do so by law. Where appropriate, we will give you a reasonable opportunity to remedy a breach before termination.

On termination, your right to use the Service ends. We may retain information for a reasonable period where required for backups, legal obligations, fraud prevention, accounting or legitimate business records, subject to our Privacy Policy.

13. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to the paragraph above, Plan2Price is not liable for indirect or consequential loss, or for loss of profit, revenue, business, anticipated savings, contracts, goodwill or opportunity arising from use of the Service.

In particular, you are responsible for checking estimates, quantities, measurements, prices, drawings, specifications and orders. Subject to the paragraph above, we are not responsible for losses caused by inaccurate or incomplete user inputs, failure to carry out appropriate checks, changes in supplier pricing or availability, site conditions, design or specification changes, or use of the Service outside its intended purpose.

Subject to the paragraphs above, our total aggregate liability arising out of or in connection with the Service in any 12-month period will not exceed the total subscription fees paid or payable by you for the Service during the 12 months immediately before the event giving rise to the claim, or £100 where no subscription fee has been paid.

14. No guarantee of commercial outcome

Plan2Price is designed to save time and make estimating and project information easier to manage, but we do not guarantee that use of the Service will win work, produce a particular profit, eliminate all errors or achieve a particular commercial result.

15. Changes to these terms

We may update these terms as Plan2Price develops or where legal, security or commercial requirements change. The latest version will be published on this page. Where a change materially affects an existing paid subscription, we will give reasonable notice where practicable.

16. Governing law

These terms and any dispute or claim arising out of them are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory legal rights that apply.

17. Contact and contracting party

The Service is provided under the Plan2Price name. Before paid subscriptions are launched, this section will identify the legal person or company operating Plan2Price together with the appropriate business contact details.
